1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Bizlek Digital (“we,” “us,” or “our”), governing your access to and use of our website (www.bizlekdigital.com) and the purchase of any services offered, including but not limited to ghostwriting, editing, and publishing services (collectively, the “Services”).

By engaging our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Services.

2. Services Overview

We provide professional writing, editing, and publishing assistance. All services are for the creation and distribution of legitimate, original content. We strictly prohibit the use of our Services for any illegal, plagiarized, defamatory, or infringing material. You warrant that any material you provide is your original work or you have obtained all necessary rights.

3. Ordering and Payment

  • Payment Terms: Payment for Services is due in full at the time of booking unless otherwise agreed in a separate Service Contract. For Publishing packages, payment is required in full before any distribution process begins.

  • Payment Methods: We accept payments via credit card and other methods as specified on our website.

  • Taxes: You are responsible for any applicable sales, use, or other transactional taxes.

4. Intellectual Property

  • Client Materials: You retain all copyright and intellectual property rights in any materials, ideas, or concepts you provide to us.

  • Work Product: Upon receipt of full and final payment for the Services, all copyright and intellectual property rights in the final written work product created by us for you (the “Work Product”) will be assigned to you. Until full payment is received, we retain all rights to the Work Product.

  • Portfolio Rights: We retain the right to display non-confidential excerpts of completed Work Product in our portfolio and marketing materials unless otherwise stipulated in a separate Non-Disclosure Agreement (NDA).

5. Client Responsibilities and Revisions

  • Client Feedback: You agree to provide necessary feedback, materials, and approvals in a timely manner. We request feedback within 3 business days for each revision round. Failure to provide feedback may delay project completion.

  • Revisions: Our quoted fees include reasonable, “unlimited” revisions as defined in the specific service package. This is intended for refinement and corrections, not for substantial changes in scope or direction. All revision requests must be made during the active project period. No revisions will be provided after the project has been formally completed and delivered.

  • Project Inactivity: If you are unresponsive for more than 15 consecutive business days after a request for feedback or materials, we reserve the right to deem the project inactive and close it. To re-open a closed project, a renewal fee may be required.

6. Confidentiality

For certain Services, particularly Ghostwriting, a separate Non-Disclosure Agreement (NDA) will be provided and must be executed prior to the commencement of work. All Services are governed by a Service Contract that outlines specific deliverables and terms. We are committed to maintaining the confidentiality of your information and project details, both during and after the service period.

7. Publishing Services Specific Terms

  • Platform Compliance and Timing: We will prepare and submit your manuscript to publishing platforms (e.g., Amazon, Apple Books) according to industry standards. However, final approval, review times, listing visibility, and sales performance are solely at the discretion of each platform and are beyond our control. We make no guarantees regarding platform acceptance, review timelines, or sales outcomes.

  • Royalties and Reporting:

    • If your book is published under our platform account, we will provide aggregated sales reports. Royalties earned will be paid to you via PayPal or another agreed-upon method once your accrued balance reaches a minimum threshold of $99 USD.

    • If your book is published under your own platform account, you will receive all sales reports and royalties directly from the platforms.

  • ISBN & Cover: We do not provide ISBNs or book cover design as part of our standard packages. You may purchase an ISBN as an add-on service, or you may obtain your own. You are responsible for securing a professionally designed book cover that meets platform specifications.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or our Services, whether in contract, tort, or otherwise, is limited to the total amount you paid us for the specific Service giving rise to the claim.
In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services.

9. Termination

Either party may terminate an ongoing Service with fourteen (14) business days’ written notice to the other party. If Services are terminated after work has commenced, you remain responsible for payment for all Services rendered up to the termination date. No refunds will be provided for Services that have already been performed.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in Texas.
